hockeyscott76 asked: I am considering taking out a 401K loan to invest in an IRA in order to lower my adjusted gross income so that I may take the first home buyer tax credit that was introduced last month. Is there a tax penalty for doing this?

David L asked: I have never bought a house but my wife did have one when we got married that we now live in. My name is not on the loan but we do have joint bank accounts. Does my wife’s homeowners status disqualify us from the 8k credit?
My wife would not be on the loan for the new house–does that change answer number 1?

Surjit T asked: I am a 1st time home buyer and am in a high tax bracket (33%). I am considering whether I should accept points and buy down the rate and claim all the points (approx $11,000) in the current year when I file my returns next year? This is not a refinance mortgage.

Rossonero NorCal SFECU asked: Or does prop. 13 force counties to stick with the original price a buyer paid for the home? I want to take a very small home equity loan out ($5,000), but it may not be worth it if my tax bill goes up 50%.
